These Website Terms of Use sets out our approach to ensure you (our customers, audience and/or stakeholders) are informed about what occurs when using a Lovatts Media website and associated social media pages. It also provides information about how you can approach us about your website related concerns and complaints, and how we will deal with such communications.

3. Compliance with Australian Consumer Law

Lovatts Media complies with the Australian Consumer Law (ACL), contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded or limited under the ACL or any other applicable law.

Under the ACL, consumers are entitled to certain statutory guarantees in relation to goods and services. Where Lovatts Media fails to meet a consumer guarantee, you may be entitled to a remedy – including repair, replacement, or refund – depending on the nature of the failure. These rights apply regardless of any other terms in this document or any other Lovatts Media policy.

4. Purchasing, Fees and Payments

Lovatts Media’s websites offer premium products, services and subscriptions for a fee. Payment and other applicable terms relating to your use of the products and services, if any, will be disclosed to you at the time you sign up for any fee-based products or services and you will be subject to those additional terms.

Orders
Any order placed through a Lovatts Media website is an offer by you to purchase the specified product or service. We reserve the right to accept or reject any order for any reason, including errors in pricing or product information, or unavailability of the product or service. If your order is rejected, we will notify you and arrange a full refund of any payment taken.

Pricing
All prices are displayed at the time of purchase and are inclusive of GST where applicable. We reserve the right to change prices at any time. Where a price change affects an existing subscription, we will provide reasonable prior notice before the change takes effect.

Online purchases may be made using VISA, Mastercard, and any other payment methods displayed at the time of checkout.

Refunds
Subject to your rights under the Australian Consumer Law, fees for products and services purchased through Lovatts Media websites are non-refundable. 5. Subscriptions

General
Lovatts Media offers magazine subscriptions on either a one-time payment or auto-renewing basis. Each subscription covers a set number of issues or items delivered directly to you by post. The type of subscription and its terms will be clearly displayed at the time of purchase. Full subscription terms, including delivery, cancellation, and refund conditions, are set out in our Subscription Terms and Conditions at www.lovattsmagazines.com/subscription-terms.

Auto-Renewing Subscriptions
Where a subscription is offered on an auto-renewing basis, the following terms apply:

Before your subscription term ends, you will receive advance notice that your subscription is due to auto-renew. This notice will confirm the full amount to be charged, the number of issues included in the next term, and the scheduled renewal date.
On the renewal date, your nominated payment method will be charged for the next subscription term unless you cancel before that date.

Cancellation after a renewal charge has been processed will not entitle you to a refund of that charge, except where required by the Australian Consumer Law.
Promotional pricing, discounts, and gifts with purchase apply to the initial subscription period only and do not carry over to renewal periods unless expressly stated.

One-Time Payment Subscriptions
One-time payment subscriptions will not renew automatically. No further charges will be made without a new order being placed by you.

Gift Subscriptions and Gift Vouchers
Gift subscriptions and gift vouchers are non-refundable once purchased, except where required by the Australian Consumer Law. Gift vouchers must be redeemed by the expiry date shown at the time of purchase. Lovatts Media is not responsible for lost, stolen, or damaged gift vouchers. Gift vouchers have no cash value and cannot be exchanged for cash.

6. Your responsibilities

You may use Lovatts Media’s websites and associated social media pages for lawful purposes only. You may not submit or transmit any material, or engage in any conduct, that:

violates or infringes the rights of others including patent, trademark, trade secret, copyright, publicity or other proprietary rights
is unlawful, threatening, abusive, harassing, defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortious, or contains explicit or graphic sexual content
victimises, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability
impersonates any person, business or entity, including Lovatts Media Group and its employees and agents
contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorised use of a computer or computer network
encourages conduct that would constitute a criminal offence, or that gives rise to civil liability
violates the Terms of Service, guidelines or any policy posted on Lovatts Media’s websites
interferes with the use and enjoyment of our websites by other users
damages, disables, overburdens, or impairs our servers or networks or
attempts to gain unauthorised access to any services, user accounts, computer systems or networks, through hacking, password mining or any other means.

Lovatts Media may take any legal and technical remedies to prevent the violation of this provision and to enforce the Website Terms of Use.

7. Children’s Privacy and Age Restrictions

Some Lovatts Media publications are directed at or suitable for children, including Teen Breathe, Puzzle Fun for Kids, and Kids Bumper Puzzle Fun. We take the privacy of children seriously.

Our websites are not intended to collect personal information from children under the age of 13 without verifiable parental or guardian consent. If you are under 13, please do not submit personal information to us without the involvement of a parent or guardian.

Parents or guardians who believe a child under 13 has provided personal information to Lovatts Media without consent should contact us at mail@lovattsmedia.com so that we may arrange deletion of that information.

We comply with applicable Australian laws relating to children’s privacy, including the Children’s Online Privacy Code framework being developed under the Privacy and Other Legislation Amendment Act 2024 (Cth), and will update our practices as required when that Code comes into effect.

15. International use

If you choose to access a Lovatts Media website from a location outside Australia you do so on your own initiative and you are responsible for compliance with local laws.

16. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of the State of New South Wales, Australia. By using our websites, you submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. Nothing in this clause limits any right you may have under the Australian Consumer Law or any other applicable mandatory law.

17. Termination
